Terms of service

These terms are an agreement between you and Rising Eclipse LLC("we", "us"). They apply when you create an account, use this website, or install our browser extension. If you do not agree to them, do not use the service.

What the service does

Auto Apply stores the information you give us and uses it to fill in and submit job applications on your behalf, on websites you choose. Our browser extension performs those actions in your own browser, using your own logged-in session.

We are not an employer, a recruiter, or an employment agency. We do not review applications, represent you to employers, or have any relationship with the companies you apply to.

You are the applicant, and the applications are yours

This is the most important thing on this page. When the software submits an application, you are the person applying. Every statement in it is your statement, made by you, and you are responsible for it — including your work history, your eligibility to work, your answers to screening questions, and any voluntary self-identification you chose to provide.

You are responsible for making sure the information in your profile is accurate and current before you use the service to apply. Submitting false information to an employer may have consequences for you, including withdrawal of an offer or termination of employment, and those consequences are yours and not ours.

By using the autopilot, you authorise it to submit applications containing your information, and to accept the routine acknowledgement checkboxes an application requires, on your behalf. You remain bound by whatever is submitted. The service offers a dry-run mode that stops before submitting so you can review its behaviour first, and we recommend using it.

Your account

You must be at least 18 years old and legally able to enter a contract. Keep your password confidential; you are responsible for activity under your account. Tell us promptly if you believe it has been used without your permission.

One account per person. Do not share it.

Acceptable use

You agree not to:

  • submit information you know to be false, or apply on behalf of someone else;
  • use the service in a way that breaks the terms of a job board or employer website — many prohibit automated submission, and it is your responsibility to know the rules of the sites you use;
  • attempt to exceed, disable, or work around the limits of your plan;
  • copy, resell, reverse-engineer, or build a competing product from the service;
  • use the service to send anything unlawful, harassing, or malicious.

We may suspend or close an account that breaches these terms, without refund.

What we do not promise

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Specifically, we do not promise that:

  • you will receive interviews, offers, or employment of any kind — we have no influence over hiring decisions;
  • any application will be delivered, received, read, or considered;
  • the software will correctly read, fill, or complete any particular website's form — career sites change constantly and without notice, and some actively block automated use;
  • job listings shown to you are accurate, current, or still open — they come from third-party sources we do not control;
  • the service will be uninterrupted or error-free.

Limits on our liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, lost wages, or damage to reputation — including any claim arising from a job you did not get, an application that was not submitted, an application that was submitted incorrectly, or information submitted to an employer.

Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Nothing in these terms excludes liability that cannot lawfully be excluded — including liability for fraud, willful misconduct, or gross negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold us harmless from claims, losses, and reasonable legal costs arising from your use of the service, the information you submitted through it, or your breach of these terms.

Free trial

New accounts start with a 7-day free trial that includes a limited number of applications. A valid payment method is required to start the trial. When the trial ends, it converts automatically into a paid Starter subscription and your saved payment method is charged — this is disclosed at signup and on the payment page, and we email a reminder before the first charge.

You can cancel at any time during the trial from your billing page, in which case you are not charged and your access ends when the trial does. Using up the trial's included applications early does not trigger an early charge; billing still happens on the disclosed conversion date unless you choose to start your paid plan sooner. Free trials are limited to one per customer.

Payment, cancellation and refunds

Paid plans are billed monthly in advance and renew automatically until cancelled. You can cancel at any time from your billing page; your plan continues until the end of the period you have already paid for, and we do not refund partial months.

Plan allowances reset monthly and unused applications do not carry over. We may change prices with at least 30 days' notice by email; the new price applies from your next renewal.

Third-party sites

The service interacts with employer and job board websites we do not own or control. Their terms and privacy policies govern what they do with your information once an application reaches them. We are not responsible for their content, conduct, or decisions.

The browser extension

The extension runs in your browser and acts only on pages for jobs you have queued. It requires permission to access websites in order to fill forms there, and Chrome will ask you for that permission. You may uninstall it at any time, which stops all of its activity immediately.

Ending it

You may stop using the service and delete your account at any time — see the privacy policy for how. We may suspend or end your access if you breach these terms, or discontinue the service with reasonable notice.

Changes to these terms

We may update these terms. If a change materially affects your rights we will tell you by email before it takes effect. Continuing to use the service after that means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and the courts located there have exclusive jurisdiction over any dispute.
